Don’t sign away your rights

As corporations become more and more fearful of lawsuits stemming from their own negligence, they continue to try to protect themselves by making their customers and clients sign arbitration agreements as part of their contracts. These arbitration agreements eliminate the right for you to bring your case in front of a judge and jury if you’ve been injured due to a corporation’s negligence.

The Boston Herald recently did a story on nursing homes that take advantage of some of our most at-risk citizens by urging seniors to sign complex nursing home contracts with arbitration agreements tucked away inside. This means that the nursing home is less likely to pay for gross negligence or outright abuse of its patients because arbitration agreements almost always result in lower awards for victims and less legal fees for the facility.

Can it get any worse for Toyota

People have probably started to become numb to all the automotive recall news they have heard over the last month. Toyota was probably starting to think they were gaining control of their problems until a story like this appears. Thankfully no one was injured but what a hair-raising ride. Imagine being behind the wheel of your runaway Prius – at least it wasn’t a Ferrari – driving down a busy California interstate.

Recalled or not

In the midst of all the automotive recalls, it is getting difficult to say the least to determine if the car you drive has been affected. If it’s a Toyota there’s a real good chance that you have a problem even if the car was taken in for service.  GM and Nissan are also culprits.

Recalled children’s silverware

The CPSC and Peachtree Playthings of Atlanta, Ga are working together on the voluntary recall of a faulty fork and spoon set. The recalled designs are Scooby Doo, Tweety and Batman Fork and Spoon Sets. The middle two prongs have been found to break off and pose an immediate choking hazard to children. The fork and spoon sets were sold at Dollar Tree Stores during January 2010 and were manufactured in China. If you have these fork and spoon sets, take them away from children immediately and return them for a full refund. A picture of the recalled items can be found on this link.

The latest car recall

Add GM to the list of car manufacturers issuing a large recall for some of their automobiles this year. Doesn’t sound quite as bad as the problems at Toyota but it’s only day one. I have only briefly glimpsed at the available related stories – the funniest of which is that GM is blaming it’s woes on a part supplier owned by Toyota.

Come on General Motors – stand up and take it like a big boy. They were quick to lease their monthly sales reports this morning. Was that because they were good sales or to try and throw up some smoke for cover?

Motorcycle safety

With our recent warm spell this weekend, I was quickly reminded of the number of motorcycles that share our North Florida roads. My kids and I actually had a contest to see who could count the most as we drove around town. Now that the weather has turned cold again I am pretty sure that some of the less avid bikers may put the hog back in the garage. The cold won’t last long (or at least I hope not) and they will all be out in full force enjoying our fabulous spring time weather.

Just as motorists look out for other motorists, we should always look out for others sharing the roadways – motorcyclists and cyclists alike. Check that blind-spot carefully and maintain traffic awareness at all times. The roads aren’t getting any less crowded but we can keep them safe by practicing safe driving. Be patient – I’d rather be 2 minutes late for something than be involved in a traffic accident and potentially injure someone or be injured myself.

Social Security Update

UPDATE – President Obama signed this into law on 2/27/10.

Attorney Mark Papa from our Jacksonville office shared this bit of breaking news with me. Sounds like good news for Social Security Applicants.

 
The Social Security Disability Applicants’ Access to Professional Representation Act of 2010 is expected to be signed into law by President Obama by the end of this week.  This will allow those who are denied Supplemental Security Income (”SSI”) benefits in the future to find an attorney to represent them in their claim.
 
Prior to the Social Security Protection Act of 2004 (”SSPA”), there was no attorney fee withholding provision for SSI claims, the consequence being that very few attorneys would agree to represent SSI claimants.  SSPA included a provision whereby attorney fees would be withheld and paid directly in SSI cases.  This provision in the SSPA is scheduled to “sunset” on March 1, 2010.
 
The signing into law of the Social Security Disability Applicant’s Access to Professional Representation Act of 2010 will ensure that SSI claimant’s who have been denied will continue to find attorney representation before the Social Security Administration.

Voluntary recall due to burn hazard

Here’s a link to the Consumer Product Safety Commission (CPSC) recall notice concerning faulty tea kettles.

About 132,000 enameled steel tea kettles distributed by Copco, a division of Wilton Industries of Woodridge, IL have been recalled due to the possibility of the handle becoming loose and creating a burn hazard resulting in severe personal injuries and disfigurement. The recall involves Copco and Wild Life Tea Co. Bristol model and Martha Stewart Collection Enameled Steel Tea Kettles in various colors. Toyota recall

Do you get the feeling that there is still more breaking news to come regarding quality control at Toyota? Is this the classic story of a big corporation relying on their bean counters to tell them what is the most economical decision instead of the right decision?

Social Networking investigation

More and more people are getting caught up in the social networking phenomenon that is spreading across the globe. Even businesses like ours are taking advantage of the popular networking sites.

Guess who else is taking advantage of these tools – the insurance companies. They typically look for anything and everything they can use to defend against a personal injury claim. Throw it up on the wall and see what sticks seems to be a popular theme. Don’t throw up on the wall for them. The police are also using social networking as a powerful investigative tool.

Whether it be for my own personal networking or for Harrell & Harrell, PA, I keep the same idea in mind which is – nothing on the internet is private so I ensure my posts and other communications are appropriate and that I am willing to have it seen by anyone who might come looking for it. You should consider that same idea. Another thing to consider is the fact that the rules can and do change frequently. What you may think is private or by invitation only may soon be available to the general public. Think twice before you post that next picture or update your status – someone other than your mother may be watching!
